Terms and Conditions, Permission and Waiver

Below is a copy of the Terms and Conditions, Parent/Guarding Waiver and Release of Liability and Permission Form, and Assumption of Risks, which you, the parent/guardian have agreed to by clicking ‘I accept’ on the Camp Manitou registration form.

Terms and Conditions, set forth by Camp Manitou and Four Seasons Resort Hualalai.*
I agree to the charges (plus Hawaii state tax of 4.1666%) to be added to my room account.

I also understand that extra charges will apply for the custom activities, if selected. These charges will be added to my room account.

Rules and Regulations

The camper ( Camper ) and parent(s) ( Parent ) agree to abide by all of the rules and regulations established by Camp Manitou ( Camp ), Four Seasons Resort Hualalai, and all program partners including, without limitation, those relating to enrollment and withdrawal of campers, visitation and conduct.

Cancellation

Any family may cancel enrollment up to 48 hours prior to the participation date without penalty. If cancellation is within 48 hours, the full camp fee will be charged. This includes regular camp days, 3rd party payments, overnight trips and family days. The 48 hours is measured from 7:30am on the day of the participation date.

Refunds

No refunds are to be made for campers dismissed for misconduct of disciplinary reasons (recurring misconduct, illegal acts such as using non-prescription drugs, illegal drugs or consuming alcoholic beverages, or acts by parents of family members contrary to camp policy disruptive to the camp program and detrimental to the better interest of the camp community).

Dismissal

The camp reserves the right to dismiss, in its sole discretion, and camper whose condition, conduct, influence or behavior is deemed unsatisfactory or detrimental to the best interests of the camp or fellow campers or who violates camp rules and regulations, in which case no refunds will be made.

Medical Care

Parents grant Camp Manitou permission to secure any and all medical and/or surgical treatment and hospital service the camp deems necessary for the camper’s well being. Should it be necessary to for the camper’s well being to use outside medical care, all expenses involved will be paid by parent(s). In addition, any dental, orthodontic, or optical work will be paid by parent(s). Medical care provided by the camp physician is included in the tuition.

Camper Medical Information

Parent(s) must inform the directors prior to registration if the Camper has received professional counseling or medication for behavioral modification during the last 12 months. Parent(s) must also inform the directors immediately if such care or medication occurs after registration and prior to the camp season. Failure to so inform the directors may lead to dismissal of the camper from camp, and in the event of such dismissal, there will be no refund. A complete medical history signed by a physician is required for enrollment.

Sunscreen

Parent(s) grant permission for Camp Manitou staff to apply sunscreen to campers through out the day to avoid sunburn.

Permission to Participate

Parent(s) grant permission for camper to participate in all camp activities, excursions, and special outings and understands that accidents and injuries may occur in the natural course of participation in such activities. Images ect… Camp Manitou is granted permission to use any individual or group photographs, video and audio recordings taken at camp or elsewhere documenting camper in camp activities for publicity on social media and/or other promotions.

Marketing By registering for Camp Manitou at Four Seasons Hualalai, you agree to receive occasional newsletters and information about upcoming sessions. Your email address and privacy is safe with us, we will not share your details with anyone. You can unsubscribe from the newsletter at anytime.

Belongings
Camp is not responsible for camper’s belongings or equipment while in transit or on Four Season property.

Effective date, disputes

This application shall take effect and become binding when (a) signed parent, (b) returned to camp, and (c) accepted by camp. Any individual bringing legal action against camp, which action is decided in favor of camp, will be responsible for all legal fees, court costs and out-of-pocket expenses of Camp, its owners and employees.

Parent/Guarding Waiver and Release of Liability and Permission Form

I, the parent/guardian of the registrant, a minor, hereby grant permission for my child/ren named above to participate in the Camp Manitou activities. In consideration of being permitted to participate in any way in camp activities, I, on my behalf, on behalf of my child/ren and my and his/their personal representatives, executors, heirs, and assigns, do hereby release, waive, discharge and covenant not to sue Manitou Operating Co LLC, its agents, officers, volunteers, participants, employees, and all other persons or entities acting in any capacity on its behalf (hereinafter collectively referred to as “Camp Manitou”), from any and all injuries, losses or liabilities arising from, but not limited to, my child’s participation in Camp Manitou Summer Camp. I grant permission for Camp Manitou personnel, aged 21 and over, to transport my child to and from the field trip sites and the Four Seasons Hualalai. In a medical emergency, I give Camp Manitou permission to take my child to a hospital for examination and treatment of injuries, x-rays and other necessary care.

Assumption of Risks: I fully understand and acknowledge that:

1) risks and dangers exist by virtue of the nature of the activities of hiking, climbing, ocean swimming, horse riding, kayaking, driving, camping, rock jumping, surfing, cave swimming, body surfing, body boarding, paddle boarding, snorkelling, canoeing, diving, and outdoor games and my child’s participation in such listed above activities,

2) such activities, my child’s use of equipment and/or participation in such activities may result in illness or injury or death or damage to personal property and

3) these risks and dangers may be caused by other participants, or by accidents, or by forces of nature or other causes. I understand that such risks may arise from foreseeable or unforeseeable causes and that such risks cannot be eliminated without jeopardizing the essential qualities of the activity. I hereby knowingly and voluntarily accept and assume these risks and dangers and the risks of illness, injury or death or damage to personal property on my behalf and on behalf of my child. Indemnification and Hold Harmless:

I, on my behalf, and on behalf of my child/ren named above agree to indemnify and hold Camp Manitou harmless from any and all claims, actions, suits, procedures, costs, expenses, damages and liabilities, including attorney’s fees brought as a result of my child’s involvement in the Camp Manitou program and to reimburse them for any such expenses incurred.

Acknowledgement of Understanding: I have read this waiver of liability, assumption of risk, and indemnity agreement, fully understand its terms, and understand that I am giving up substantial rights, including my right, and my child’s right to sue. I acknowledge that by clicking ‘I accept’ below, I am digitally signing the agreement freely and voluntarily and intend by my agreement of this waiver to be a complete and unconditional release of all liability to the greatest extent allowed by law.
